Terms of Service
Introduction
Welcome to CET Cor. These Terms of Service ("Terms") govern your access to and use of the CET Cor platform, including any content, functionality, and services offered on or through the platform.
By accessing or using CET Cor, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the platform.
CET Cor is intended for use by Catholic Education Tasmania staff, students, parents, and authorized stakeholders. By using CET Cor, you represent and warrant that you meet all eligibility requirements.
Definitions
"CET" refers to Catholic Education Tasmania.
"Platform" refers to the CET Cor web application and all related services.
"User" refers to any individual who accesses or uses the Platform.
"Content" refers to any information, data, text, documents, images, audio, video, or other materials submitted, posted, or displayed on the Platform.
User Accounts
To access certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify CET immediately of any unauthorized use of your account or any other breach of security.
CET reserves the right to disable any user account at any time if, in our opinion, you have failed to comply with these Terms or if we suspect misuse of the Platform.
Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to use the Platform:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
- To impersonate or attempt to impersonate CET, a CET employee, another user, or any other person or entity.
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Platform, or which may harm CET or users of the Platform.
Intellectual Property
The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by CET, its licensors, or other providers of such material and are protected by Australian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms permit you to use the Platform for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as follows:
- Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
- You may store files that are automatically cached by your Web browser for display enhancement purposes.
- You may print or download one copy of a reasonable number of pages of the Platform for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
User Content
The Platform may allow you to post, submit, publish, display, or transmit content. By providing any content on the Platform, you grant to CET and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
You represent and warrant that:
- You own or control all rights in and to the content that you post.
- All of your content is accurate and does not violate these Terms.
- Your content does not infringe upon or violate the rights of any third party.
Third-Party Services
The Platform may contain links to third-party websites or services that are not owned or controlled by CET. CET has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that CET shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
Disclaimer of Warranties
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied. CET disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
CET does not warrant that the Platform will be uninterrupted or error-free, that defects will be corrected, or that the Platform or the server that makes it available are free of viruses or other harmful components.
Limitation of Liability
To the fullest extent permitted by applicable law, in no event will CET, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Platform, including any direct, indirect, special, incidental, consequential, or punitive damages.
Indemnification
You agree to defend, indemnify, and hold harmless CET, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.
Termination
CET may terminate or suspend your access to all or part of the Platform, without notice, for any conduct that CET, in its sole discretion, believes is in violation of these Terms or is harmful to the interests of another user, a third-party, or CET.
Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Changes to Terms
CET reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, CET will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at CET's sole discretion.
By continuing to access or use the Platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Platform.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Tasmania, Australia, without regard to its conflict of law provisions.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Platform shall be instituted exclusively in the courts of Tasmania, Australia, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.
